General conditions of sale and shipping
1. Premise
The commercial relationships between FAT Elettronica and the customers are regulated exclusively by the following conditions of sale, which exceed and exclude any other agreement agreed previously or verbally.
2. Technical information
The technical information printed on the catalog is based exclusively on official data published by the producers. We reserve the right to change technical and dimensional parameters based on what will be communicated by the manufacturers.
3. Orders
Orders will be processed according to customer requests. Any alternatives to the requested product will be provided only after giving notice to the customer and having received its approval.
The orders, coming from countries outside Italy not belonging to the European Union, will be processed only after having given notice to the customer and having received its approval.
4. Prices
All prices printed on the catalog are inclusive of VAT. Prices are those in effect at the time the catalog is printed.
We reserve the right to change them, without prior notice, based on market price trends and exchange rates between the Euro and other currencies.
5. Shipping and delivery
All orders received will be sent by express courier (24 ÷ 48h) in Italy and parcel shipping (2 ÷ 3 days) in EU countries.
Shipping costs are calculated based on weight and location and country of delivery.
For the countries of the European community are calculated by the system according to the rates of our forwarder.
6. Payments
The goods supplied by us must be paid according to the methods chosen by the customer, using one of the following methods:
- Bank transfer in advance.
- Credit card.
- PayPal
7. Risk and property
The goods are shipped to the assigned port (debit of the flat-rate transport cost) and therefore the risk will pass to the customer at the time of delivery to the courier. Always check the integrity of the package upon receipt of the goods.
8. Right of withdrawal
As required by Legislative Decree n. 185 of 22 May 1999, the customer, who is a natural person who makes a purchase of an amount exceeding 25 EUR (including tax charges and incidental expenses), for purposes that can be considered unrelated to his professional activity, has the right to withdraw from the contract.
The customer who intends to use the "right of withdrawal" must send within 10 days. from receipt of the goods written communication by registered mail with return receipt to: FAT Elettronica, Via Carducci 70, 54100 Massa (MS).
For the application of the right of withdrawal, the integrity of products and packaging is an essential condition.
The goods must be returned within the aforementioned term of 10 days. from receipt of the same, frank our warehouse of Massa. Shipping costs are totally charged to the customer. FAT Elettronica will return any sums already paid by the customer, with the exception of the accessory costs that remain to be paid by the customer.
9. Request for return of goods
The request for return of goods must be sent to FAT Elettronica within 10 days of receipt of the same, specifying the reason and quoting the references of the purchase invoice. Use the RMA Request Form.
In the event of an error in the order by the customer, any authorization to return will be at the complete discretion of FAT Elettronica. In all cases it is necessary to wait for the return authorization number to be communicated, which must be indicated on the transport document and on the external packaging. The goods must also be sent within one week of the return number being communicated. The goods must be returned intact, in the original packaging, complete with accessories and protected in suitable packaging. Shipping costs are totally charged to the customer. The returned goods without the above requisites, will be rejected and sent back to Port assigned to the sender.
10. Complaints
Any shipping errors or missing material should be promptly reported to FAT Elettronica, quoting the order number.
11. Responsibility
FAT Elettronica, except in cases of willful misconduct or gross negligence, will not be responsible for any direct or indirect damage or loss deriving from delayed or non-delivery of the product, or for the non-correspondence of the goods to the specifications published in the catalog, or for any other fact not attributable to FAT Elettronica itself.
Spare parts and active and passive electronic components, laser optics, inverters are excluded from the warranty.

13. Competence
For any dispute, the competent court is that of Massa.
14. Information on data processing Pursuant to art. 13 of EU Regulation 2016/679 of 27/04/2016
1. Purpose (and legal bases of processing)
The personal data that you provide to us as well as those obtained from browsing our sites will be used for the purposes of:
provide the registration service to the site and related services, for preliminary requirements to stipulate the sale contracts, to follow up the same and to protect the resulting credit positions (execution of the contract between the parties)

The provision of data for the contractual purposes referred to in points a), b) and c) is mandatory (in the absence, it is not possible to follow up the sales contract and the provision of the related services).
For marketing purposes under point d) you will instead be required to give your consent, without prejudice to the right of revocation at any time (without prejudice to the lawfulness of the previous treatment).
2. Cookies
FAT Elettronica also wishes to inform you that by accessing the sites in the notice, "cookies" may be sent to your computer, according to the methods of use available on the relative pages of each site.
3. Data communication - Data transfer abroad
The personal data collected may be communicated, as per their specific competence, to public administrations for the performance of the institutional functions, to banks, to subjects specialized in the management of information systems and / or payment systems, to subjects who provide goods and services offered by FAT Elettronica can be used to carry out promotional, advertising, marketing and communication activities, to law firms, to persons carrying out transport or shipping activities, to subjects for which FAT Elettronica uses to carry out activities promotional, advertising, marketing and communication, legal and consulting firms, persons responsible for keeping the accounts or auditing the financial statements of the Group companies, and public authorities for the fulfillment of the law.

4. General aspects

For the purposes referred to in points a) and b) your data will be kept for the period prescribed by law.

For the purposes referred to in point d) the data will be stored until the revocation of consent or termination of the contractual relationship.
